Terms of Service

The terms that apply when we service your vehicle — estimates and authorization, payment, warranty, and what we are and aren't responsible for.

These terms cover two things: using this website, and having The PitStop Fremontservice your vehicle. Booking an appointment, dropping off a vehicle, or using this site means you accept them. If something here doesn’t sit right, call us before you book rather than after.

What we do

We’re an auto repair and maintenance shop in Fremont, serving Fremont, Newark, Union City, Milpitas, Hayward and the surrounding Bay Area. That covers oil changes, smog checks, brakes, AC service, batteries, tires and rotations, tune-ups, transmission work, check engine light diagnostics, pre-purchase inspections and rideshare inspections. Availability depends on the day, the bay and the parts. Sending a request through this site doesn’t book anything on its own — an appointment exists once we’ve confirmed it with you.

Estimates and authorization

California law is the floor here and we work to it. Before we begin repair work you get an estimate, and we don’t exceed the authorized amount without your approval first. Nothing on this website is an estimate or a quote — advertised services, prices and descriptions are general and can change.

If the job turns out to need more than what we quoted — a seized component, a part that’s failed behind the one you came in for, a fault that only shows once something is apart — we stop, tell you what it now costs, and you decide whether to go ahead. Diagnostic time is itself work, and may be charged whether or not you go ahead with the repair.

Payment

Payment is due when the work is finished, before the vehicle leaves. We take cash, credit and debit cards, checks, Venmo and Zelle. Fleet and commercial accounts can be arranged differently — ask us in advance, in writing.

Coupons, specials and advertised prices

Advertised prices and coupons apply to standard vehicles and standard parts and fluids. Vehicles that take extra oil, specialty oil, a non-standard filter, or extra labor cost more than the advertised figure, and we’ll tell you that before we start. Coupons can’t be combined with other offers unless we say so, must be presented at the time of service, apply to the service named on them, have no cash value, and expire on the date printed.

Parts and warranty

Parts we supply carry the manufacturer’s warranty; the warranty that applies to your parts and labor is the one stated on your invoice, and that invoice governs. Warranty work needs the original invoice and the vehicle brought back to us so we can look at it.

Customer-supplied parts are a different matter. We may decline to install them, and where we do install them at your request, they carry no warranty from us — not the part, not the labor to fit it, and not any consequence of that part failing. Any warranty is void where the vehicle has been abused, raced, overloaded, modified, serviced elsewhere afterwards, or operated after a fault was reported to you.

Your vehicle while it’s with us

By leaving a vehicle with us you authorize our technicians to operate it — including road tests on public roads — for the purpose of diagnosis, repair, inspection and quality check, and to move it on and around our premises.

  • Take your valuables and personal belongings with you. We are not responsible for cash, electronics, tools, documents, aftermarket equipment or any other personal property left in or on a vehicle.
  • Vehicles left outside business hours, including keys left in a drop box, are left at your own risk until we take them in the following business day.
  • Tell us about existing damage, warning lights, aftermarket modifications, anti-theft systems and known faults before you hand over the keys.

Condition of the vehicle

Vehicles come to us in the condition they’re in. On older, high-mileage, rusted, previously repaired or modified vehicles, fasteners shear, brittle plastic breaks, seized components don’t come apart cleanly and a worn part next to the one being replaced can fail during or shortly after normal service. That risk comes with the vehicle, not with our work, and you accept it when you authorize the repair. Where something like that happens we stop and talk to you rather than carry on quietly.

Repairing one fault does not mean the rest of the vehicle is sound. We service what you authorize and don’t take on responsibility for the parts of the vehicle we weren’t asked to touch.

Diagnostics

A diagnosis is a professional assessment of what the vehicle shows us at the time we look at it. Intermittent faults, multiple overlapping faults and electrical problems can take more than one visit, and a diagnosis is not a guarantee that a given repair will resolve every symptom. We’ll be straight with you about what we know and what we don’t.

Inspections — smog, rideshare and pre-purchase

Smog checks are performed to the standards and equipment requirements set by the State of California, and the result reflects the vehicle as tested on that day. We don’t control the outcome, and a failed test is a result, not a service failure.

A pre-purchase or rideshare inspection is a visual and functional assessment, limited to what can be seen and tested in the time allowed, without dismantling the vehicle. It is an opinion at a point in time, not a warranty, guarantee or prediction of the vehicle’s future condition, and it cannot reveal concealed damage, undisclosed history or a fault that isn’t presenting. Your decision to buy, sell or operate a vehicle is yours.

Recommended work you decline

If we recommend a repair for safety or reliability and you choose not to have it done, that’s your call — but you accept the risk and consequences of operating the vehicle in that condition, and we’re not liable for what follows from it. We may also decline to perform work we consider unsafe, or to release a vehicle we consider unsafe to drive without noting that in writing.

Picking your vehicle up

Collect your vehicle promptly once we tell you it’s ready. Vehicles left after that are stored at your risk and may incur storage charges. Vehicles left uncollected and unpaid may be subject to a lien and to sale under California law once the required notice period has run.

Appointments and no-shows

Tell us as early as you can if you need to move or cancel — a booked slot is a bay and a technician not doing something else. Arriving substantially late may mean rescheduling, and some services are subject to the equipment and staffing available on the day.

Using this website

Use the site lawfully. Don’t try to break it, get into parts of it that aren’t yours, or put false information into our forms. The content, layout, logo and materials here belong to The PitStop Fremontor the people we licensed them from; read and share the site, but don’t copy it wholesale. Service descriptions, availability, prices and any figures on this site are general and can change without notice.

This website is provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. We don’t warrant that it will be uninterrupted or error-free. Any maintenance guidance, article or tip on this site is general information, not advice about your specific vehicle.

Limitation of liability

To the fullest extent the law allows, The PitStop Fremont is not liable for indirect, incidental, special or consequential damages arising from your use of this website or from services we perform — including towing, rental or replacement transportation, missed work, lost earnings (including rideshare or delivery income), loss of use, or damage to property left in a vehicle.

To the fullest extent the law allows, our total liability for any claim connected to a service is limited to the amount you paid us for that service. Nothing in these terms limits any right you have under California law that cannot lawfully be limited, including rights under the Automotive Repair Act, and nothing here limits liability for fraud, willful injury, or violation of law.

If something goes wrong

Tell us first, and quickly — before the vehicle is worked on elsewhere, so we can look at it while the facts are fresh. Giving us that chance is a condition of any claim about our work. You may also raise a concern with the California Bureau of Automotive Repair.

Changes

We may update these terms. Changes apply once they’re posted and the “last updated” date above changes with them. The terms that apply to your repair are the ones posted when you authorize it.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute goes to the courts of Alameda County, California.
